Civil Appeal No. 8552/2022 titled “M/s Kisan Sahkari Chini Mills vs. UP Pollution Control Board”, represented by Khurana & Khurana, Advocates & IP Attorneys, filed before the Hon’ble Supreme Court challenging the order dated on 7th December 2021 passed by National Green Tribunal in Appeal No. 28/2021, was listed before the Hon’ble Supreme Court of India on 05.12.2022. The said Civil Appeal was in view of the rejected Appeal before the Hon’ble National Green Tribunal pertaining to the Environment Compensation imposed by the Uttar Pradesh Pollution Control Board in lieu of the Water (Prevention and Control of Pollution) Act, 1974. The said order was challenged primarily on the premise of violation of principles of natural justice since opportunity of being heard was not granted by the Uttar Pradesh Pollution Control Board and that the said arguments not being appreciated by the Hon’ble National Green Tribunal while passing the impugned Order upholding the Environment Compensation levied by Uttar Pradesh Pollution Control Board.

The Hon’ble Supreme Court of India, upon hearing the Civil Appeal, was kind enough to issue Notice and Stay the operation of the impugned Order imposing penalty upon the Client by way of Order dated 05.12.2022.
